What happens when an online casino's licence expires in Kenya
The Gambling Control Act, 2025 gives every licence a fixed period of validity and requires a renewal application before it ends. It sets no grace period after expiry. Operating online without a licence is an offence, and player balances stay governed by the same account rules.
Expiry is an end date, not a decision
A gambling licence under the Gambling Control Act, 2025 is valid for a period. Section 31(3) gives thirty-six months from the date of issue, or another period prescribed in regulations, and the regulations set the actual figures, as explained in how long a GRA casino licence lasts. When that period ends, the licence is no longer within its period of validity.
The sections read for this page contain no grace period and no automatic extension while a renewal is pending. What the law does contain is a deadline for the operator: the renewal application has to be in before the end date, not after it.
The ways a licence can end
Expiry is one of several routes, and each leaves a different trace. The table sorts them by who acts and what the text requires.
| How it ends | Who acts | What the text requires | Provision |
|---|---|---|---|
| Expiry | Nobody; time passes | Renewal application at least three months (Act) or ninety days (Regulations) before the end date | Act s.31(2); Licensing Regs r.24(2) |
| Refusal to renew | The Authority | Written notice with reasons; appeal to the Committee within twenty-one days | Act s.32 |
| Revocation | The Authority | Notice of at least twenty-one days; licensee surrenders the licence | Act s.33; Licensing Regs r.26(7) |
| Suspension | The Authority | Notice, a chance to be heard, then public notice | Act s.34 |
| Winding up | The licensee | At least ninety days' written notice; licence surrendered within seven days for cancellation | Operations Regs r.99 |
Only the first row happens by itself. The others are published acts, and the Authority must publish a suspension or revocation in the Gazette and in two newspapers of nationwide circulation or other media of national coverage (Act s.34(3); Licensing Regs r.26(9)).
If renewal was refused
Section 32 lets the Authority refuse to renew where the information supplied is false in a material particular, or the application does not meet the requirements, or it does not conform to the policy on software systems. The Authority must notify the applicant in the prescribed form with its reasons, and the applicant may appeal to the Committee within twenty-one days of the notification. Regulation 24(4) of the Licensing Regulations adds that written reasons for a rejected application are due within fourteen days of the decision.
These are the licensee's rights, not a player's. A player cannot see the file, so the practical effect is only that a licence may end without the casino announcing it.
Operating after the end date
Section 67(1) says a person who desires to operate, sell or promote online gambling in Kenya shall apply for a licence from the Authority. Without a licence in its period of validity, a site is therefore in the same position as one that never applied. Section 92 of the Act makes it an offence to aid the unlicensed management of an electronic gambling site or to solicit a person to bet in an unlicensed gambling site, with a fine of up to one million shillings or imprisonment of up to one year, or both. The wider picture is in the penalty for an unlicensed online casino.
Section 36(3) requires a holder of an online gambling licence to display the licence on its online platform. A displayed licence number is not proof of validity, because the number can stay on a page after the period has ended.
What stays the same for your balance
Nothing in the sections read cancels a player's claim to money held in an account because the licence has ended. Section 75 still restricts what a licensee may do with a balance to three uses, and section 77(1) requires a balance to be remitted where no transaction has been recorded for three months. For the account rules in full see what happens to your balance when an account is closed.
Where a licence is revoked, regulation 26(5) requires the licensee to take measures to safeguard player deposits, personal liabilities and personal data. Regulation 26(7) requires surrender within seven days of notice and an end to business. No text read states how fast or in what share a player is repaid, so this page makes no promise on that.
Gambling is addictive. If you are unsure whether an operator still holds a licence, do not add money to the account until the Authority has answered you.
Illustrative example: counting the renewal deadline
Illustrative example: suppose a licence expires on 30 June 2027. Three months before is 30 March 2027. Ninety days before is 1 April 2027, because 29 days remain in April after the 1st, plus 31 in May and 30 in June, which makes 90. The three-month rule gives the earlier date, so an operator following both texts applies by 30 March 2027. The dates describe no real licence.
If an application is lodged by that date, regulation 24(3) says the Authority shall issue the licence to a successful applicant within thirty days of the application. That is a duty of the Authority and does not tell a player whether an application was made.
How a reader can find out
- Match the company and licence number against the regulator's list, using how to check an online casino licence in Kenya.
- Note that the list covers the 2025/26 trading period and its page was last modified on 2026-03-19, and open the live page.
- Ask the Authority in writing for the expiry date, since section 39 requires it in the register of licences and makes the register open to the public on payment of the prescribed fee.
- Telephone the GRA toll-free line, 0800-723-770, if the answer affects money already in an account.
The columns of the list are explained in how to read the GRA list of licensed operators. A line on that list is a record for a past period and is not a statement of validity on the day you read it.
Transition from the old Act
Licences issued under the repealed Act stayed valid for their period (Act s.122(1)), and their holders had to apply to the Authority for a new licence on expiry (s.122(2)). Regulation 30 of the Licensing Regulations kept such licences in force for sixty days from publication of the Regulations and required an application for the appropriate licence within that time. A listing that predates these rules cannot be assumed to be current.
Questions and answers
Is there a grace period after a licence expires?
None appears in the sections of the Act and the Licensing Regulations read for this page. Section 31 asks for a renewal application at least three months before expiry, and regulation 24(2) at least ninety days before. Ask the Gambling Regulatory Authority whether a particular licensee has applied.
Can a casino keep taking deposits on an expired licence?
Section 67(1) of the Act requires a licence from the Authority to operate, sell or promote online gambling in Kenya. The sections read do not authorise operation after the period of validity has ended, and section 92 makes aiding unlicensed management of an electronic gambling site an offence.
What happens to my balance if the licence lapses?
Section 75 still limits what a licensee may do with a balance: debit a wager, remit it at your request or pay bank charges. The Act does not set out a special repayment procedure for a lapsed licence, so ask the casino in writing and keep the reply.
Does the GRA list show that a licence has expired?
No. The published list shows company, trading name, licence numbers, status and domain for the 2025/26 trading period, with no expiry column. Section 39 requires the Authority to record the date of expiry in its register of licences.
Is expiry the same as revocation?
No. Expiry is the end of the period of validity. Revocation under section 33 is a decision by the Authority after notice, and the licensee must surrender the licence. Suspension under section 34 is a third case, with a public notice.
