Casino account closed: what happens to your balance in Kenya

The money in your account stays yours. Section 75 of the Gambling Control Act lets a licensee deal with a balance only to debit a wager, remit it at your request or pay bank charges, so a closure does not by itself end your claim. Closure grounds and notice periods are not set out in the sections read.

Start with who closed it and why

A closed account is not one event in law. The consequences differ depending on whether the casino closed it, you closed it, you self-excluded, or the company itself stopped trading. The table below sorts the cases against the provisions that matter.

Every duty here belongs to a licensee, so first check the casino's licence against the regulator's list. Note the company name and licence number exactly as the Gambling Regulatory Authority (GRA) shows them.

What the law says about the balance, by situation

The casino closes the account

The Act requires a licensee to keep an account for every registered player and to credit to it all funds received from the player and all funds owed to the player (s.73). Section 75 then limits what the licensee may do with what stands to your credit. Closing the account is not one of the permitted uses, so the balance remains payable to you.

The sections read do not list grounds on which a casino may close an account, and they do not set a notice period. The terms of the account may do so, and the licensee must make the rules of its games and any processing fee available to you (s.72(6)). Read them, but note that terms cannot widen the three uses in section 75.

Two checks may legitimately precede a payment. Regulation 85(3) requires the winner's identity to be verified before winnings are paid, and section 70(6) requires proof of age of majority before a prize is remitted. A request for documents after closure is therefore not by itself a breach, though an open-ended hold on your own deposit is not described anywhere in the sections read.

Where the licensee holds the money

Section 76(2) requires the money held to be at least equal to the total standing to the credit of all players' accounts, and a shortfall must be made good from the licensee's own money within thirty days from the end of the month in which it occurs. Section 76(3) bars a licensee from enforcing a charge, write-off, set-off or other claim against a player's bank account. The wider picture is in whether player funds are kept separate.

An idle account: the three-month rule

Section 77(1) matters if the casino says your account was closed for inactivity. Where a transaction has not been recorded on the account for three months, the licensee shall remit the balance to the player. The Act does not say how, so expect the licensee to use the withdrawal method on file, and ask in writing if it does not.

Illustrative example: your last recorded transaction was on 10 March and the account then held KES 1,850. Three months after 10 March is 10 June. From that point the licensee is required to remit the KES 1,850 to you, not to keep it, and the unchanged amount is your claim. The date and the amount are invented to show the counting.

You close the account, or self-exclude

If you ask the licensee to remit your funds, section 75(b) is the permitted use. Keep the request and the reference of the payment out. Self-exclusion works differently: under section 115(4)(d) the licensee closes the account and returns the funds held, and under section 115(5) failure to implement a written request within seven days is an offence. The process is covered in how to self-exclude from online casinos in Kenya.

Gambling is addictive: play responsibly. If closing an account is part of stepping back from gambling, the responsible gambling page lists the GRA toll-free line and support options.

The company stops trading or loses its licence

Regulation 99 of the Operations Regulations asks a licensee that wishes to wind up to give the Authority written notice at least ninety days ahead. The notice must state the reasons, the method for refunding punters' deposits, the method of settling winnings, how personal data will be disposed of and the shutdown procedure. The Authority publishes the intended winding up on its website.

Regulation 26 of the Licensing Regulations lets the Authority suspend or revoke a licence, for example where the licensee is insolvent or unable to conduct its operations. After revocation the licensee must take measures to safeguard player deposits (r.26(5)). Neither regulation says how fast, or whether in full, a player is repaid, so this page makes no claim on that.

If the balance is not returned

Write to the casino's customer care centre and keep a copy. Regulation 103 requires a licensee to have internal dispute resolution mechanisms approved by the Authority. Include the account identifier, the closure date, the amount in KES, the deposit references and the provision you rely on.

If that fails, move to the regulator. The steps for an unpaid withdrawal are in casino withdrawal not paid in Kenya, and the complaint route is in how to complain about an online casino. Section 80 of the Act sets a fourteen-day window to appeal an online gambling dispute to the Tribunal, so note the date of the closure at once.

The register is a snapshot

The Authority's list of licensed gaming companies describes the 2025/26 trading period, and the page was last modified on 19 March 2026. A company may have been suspended, revoked or added since, so check the live register before relying on a licence.

Questions and answers

Can a licensed casino keep my balance when it closes my account?

The Act does not give it that power. Section 75 allows a licensee to deal with an amount standing to the credit of a player's account only to debit a wager, to remit funds at the player's request or to pay bank charges for deposits received and funds withdrawn.

Does the law say when a casino may close an account?

The sections read for this page do not list grounds for closing an account or a notice period. They do require a licensee to cancel the registration of a player who gave false information (s.72(5)) and to close the account of a person who self-excludes (s.115(4)(d)).

What happens to money in an account I have not used for months?

Section 77(1) says that where no transaction has been recorded on a player's account for three months, the licensee shall remit the balance to the player. If the player's whereabouts stay unknown for five years, the money is presumed abandoned and goes to the Unclaimed Financial Assets Authority (s.77(2)).

Do I get my money back if I self-exclude?

Section 115(4)(d) requires the licensee to close the customer account of an individual who has entered a self-exclusion agreement and to return any funds held in it. A licensee that does not implement the request within seven days of written notification commits an offence (s.115(5)).

What if the casino is closing down or loses its licence?

A licensee that wishes to wind up must give the Authority at least ninety days' written notice with its method for refunding punters' deposits (regulation 99 of the Operations Regulations). On revocation it must take measures to safeguard player deposits (regulation 26(5) of the Licensing Regulations). Neither text sets a repayment deadline for players.

What if the operator is not on the regulator's list?

These duties bind licensees only. For a company that is not on the Authority's list there is no licensee to direct, and the texts read give no route to recover a balance from an unlicensed operator.
