What is the minimum age to gamble online in Kenya?

Gambling in Kenya is for adults only. The Gambling Control Act, 2025 bars children from online gaming and makes licensees demand proof of age of majority before registration and before a prize is paid. The regulations name eighteen years as the line in their child-protection rules.

What the law says about age

The question has a short answer and a careful one. The short answer is that only adults may gamble, and this site treats 18 as the minimum age. The careful answer is that the Gambling Control Act, 2025 works through the word "child" and the phrase "age of majority", and the number eighteen appears in the regulations rather than in the sections on online registration.

Section 72(2) of the Act says an operator shall put in place mechanisms to ensure that a child is not registered for an online game, lottery or bet. Section 72(3) adds that an operator shall require proof of age of majority prior to the registration of every player. Section 72(4) allows the Authority to make regulations on preventing the registration of children.

Where eighteen is printed, it is in rules that protect minors. Regulation 95(1)(c) of the Conduct of Gambling Operations Regulations, 2026 bars prize competition material that targets or appeals to persons under the age of eighteen years. Regulation 6 of the Advertising Regulations refers to depictions of persons who appear under eighteen years of age. What an age check involves in practice

Regulation 85(2) tells licensees to use reliable, independent and electronically verifiable data sources. Regulation 85(4) says verification includes official identification documents. Regulation 98(2) separately requires verifying the identity of all punters under the know-your-customer rules of the Proceeds of Crime and Anti-Money Laundering Act.

So an adult should expect to be asked for a national identity card or passport, and should expect the check to happen before the first deposit is accepted. A casino that takes a deposit first and asks for documents only when you request a withdrawal is working against regulation 85(1). Regulation 85(3) also requires identity verification of a winner before payment, which is a second check, not a substitute for the first. Age is one of several eligibility limits

Being an adult is necessary but not enough. Regulation 94(1) also bars a person who is excluded from gambling activities, a person who does not possess legal capacity under any law, and a person prohibited by any law from taking part. A licensee must therefore check more than a date of birth.

Regulation 85(4) says the verification confirms that the individual is not a self-excluded person and is legally eligible to take part under the Act. An adult who has chosen exclusion stays barred for the period selected, as described in how to self-exclude from online casinos.

Advertising and children

The age rule also limits what operators may show. Section 87(2)(c) requires a gambling advertisement to prohibit children from playing. Regulation 9 of the Advertising Regulations says an advertisement shall not appeal to minors, and regulation 14 sets the penalty for an unapproved or prohibited advertisement at a fine of up to one million shillings or up to six months' imprisonment, or both.

Regulation 95(1)(d) and (e) of the Conduct of Gambling Operations Regulations go further for prize competitions: no cartoons, toys, child-oriented images or language likely to attract minors, and no promotion in schools or children's clubs. Regulation 95(2) requires digital and mobile entry platforms for prize competitions to include age verification to prevent access by minors.

Parents and guardians

The online rules leave no room for permission by a parent. Section 84(3) does mention a parent or guardian, but only for amusement machines under prize licences, where no person under eighteen may play without the presence and permission of the parent or guardian. That wording does not extend to online casinos.

A parent who finds a child has registered, or has used an adult's account, can write to the operator and to the Authority. The route for doing so is set out in how to complain about an online casino. Check the operator before giving documents

Questions and answers

Is the minimum age to gamble online in Kenya 18?

The Act speaks of a child and of the age of majority without printing a number in the sections on registration and prizes. The Conduct of Gambling Operations Regulations, 2026 and the Advertising Regulations refer to persons under eighteen years in their child-protection rules, and this site treats 18 as the minimum.

Can a casino accept a deposit before it checks my age?

Not under regulation 85. A licensee must complete identity, location and age assurance checks before player account activation and before receiving any wagering deposit, using reliable, independent and electronically verifiable data sources.

Can a parent or guardian allow a child to play online?

The online rules contain no such permission. Section 72(2) tells operators to keep children from registering, and regulation 94(1)(a) lists a child among persons a licensee may not authorise to take part in any gambling activity. The only parental-permission wording in the Act is in section 84(3), which concerns amusement machines under prize licences.

What if a child used an adult's account?

The Act does not describe that case directly. Section 72(5) requires cancellation of a registration made with false information, and section 109 makes it an offence to bet with a child. If it has happened, tell the operator in writing and contact the Authority.

Does the age rule apply to casinos not on the register?

Licence conditions bind licensees. An unlicensed site owes you no such checks and gives you no route to the Authority, which is a separate reason to check the register before registering.

Who can I tell if I find a gambling advertisement aimed at children?

Report it to the Gambling Regulatory Authority. Regulation 9 of the Advertising Regulations bars advertisements that appeal to minors, and regulation 14 makes publishing a prohibited advertisement an offence.
