Can an online casino cancel your winnings in Kenya?
Only in the cases the approved rules and the law allow. The Gambling Control Act, 2025 lets a licensee touch a player's balance for three purposes only (s.75), and the one cancellation the Operations Regulations name outright is winnings obtained while self-excluded (r.74). Anything else must rest on terms approved by the Authority.
The short legal position
Kenyan law does not give an online casino a free-standing right to cancel a prize it has already declared. A licensee must credit a monetary prize to the player's account within two days (Act, s.70(1)), and it may then deal with that balance only in the three ways listed in section 75.
That does not mean a cancellation is never lawful. It means the casino has to point to a specific rule: a statutory one, or a clause in terms and conditions the Gambling Regulatory Authority (GRA) approved. This guide separates the reasons you may be given into those that have a footing in the texts and those that do not.
Step 1: confirm the operator holds a licence
Everything below describes duties of a licensee. Before you argue about a clause, check the casino's licence against the regulator's list and note the company name and licence number exactly as listed. The table of licence holders on the register page describes the 2025/26 trading period, so check the live list on the GRA website too.
Step 2: identify the reason you were given
Ask the casino to state the reason and the clause in writing. The table sets out the common reasons against what the Act and the Operations Regulations say.
| Reason given | What the texts say | Where |
|---|---|---|
| You were self-excluded | The licensee must cancel winnings obtained in contravention of the exclusion, refund deposits within seven days, and forfeit winnings to the Authority. | Regs r.74(1)(c), r.74(2) |
| You breached the terms and conditions | Terms must be submitted to the Authority for approval and must cover disqualification conditions, prohibited conduct and account suspension and closure. A clause that is not in the approved terms has no footing here. | Regs r.4(1), r.4(2)(o), (r), (s) |
| The game was declared void | A licensed casino's internal rules, approved by the Authority, must cover refund of wagers and recovery of winnings when a game is declared void. | Regs r.10(2), r.10(3)(e) |
| Suspected fraud or cheating | Winning by unlawful means is an offence. The licensee must report fraud and malpractice to the Authority within twenty-four hours. | Act s.110; Regs r.91(2) |
| The casino wants to take the balance for another reason | A licensee may only debit a wager, remit funds at the player's request or pay bank charges on deposits and withdrawals. | Act s.75 |
| Identity or age check not finished | Proof of age of majority is required before a prize is remitted. This is a delay in paying, not a cancellation. | Act s.70(6) |
Regulation 10 is written for a licensed casino and its approved internal rules. It does not say in terms that the same wording governs an online platform, so treat it as a pointer to what the Authority expects to see in approved rules rather than as a settled answer for your account.
Step 3: check what you were shown before you played
Regulation 45(1) requires a person operating an online gambling activity to display the game rules on the approved platform before a player places any wager. If a cancellation relies on a game rule that was not displayed, or on a term that is hard to find, say so in your message.
Regulation 45(2) also requires the random number generator used for games of chance to be certified by the Authority or its approved agent. A claim that a result was a "glitch" is therefore a claim about a certified system, and the casino should be able to say what failed and when.
Step 4: write to the customer care centre
Section 68(8) of the Act requires an operator to maintain a customer care centre within Kenya. Regulation 9 gives that centre the job of resolving complaints or disputes before they are reported to the Authority, and of referring unresolved matters to the Authority for determination. Regulation 103 requires a licensee to have internal dispute resolution mechanisms approved by the Authority.
Use a channel that leaves a record. Include:
- your account identifier, the date and amount of the win in KES, and the date you were told it was cancelled;
- the reason given and the clause relied on, quoted as it appeared;
- the rule that you say applies (for example s.75 or r.45(1)), and what you ask for;
- a date by which you ask for a written reply.
Step 5: complain to the Authority
Section 37 of the Act lets the Authority investigate the conduct of a licensee on its own motion or on information from any person, and direct it to rectify shortcomings. The steps, forms and contact points are in how to complain about an online casino in Kenya. The GRA toll-free line is 0800-723-770.
If the prize was credited and the casino then failed to pay it out, the separate non-payment rule in regulation 104 may be in play. It is explained in what to do when a withdrawal is not paid, and the crediting and payment deadlines are covered in the payout rules guide.
Step 6: the Tribunal and the High Court
Section 88(9)(b) lists complaints arising out of the outcome of a gambling transaction among the matters the Gambling Appeals Tribunal hears. Section 80 allows a party to an online gambling dispute to appeal to it within fourteen days from the date of the dispute, and section 90 allows an appeal from the Tribunal to the High Court within fourteen days from its decision. What the body is and does is set out in what the Gambling Appeals Tribunal is.
Because these periods are short and the Act does not say they pause during a complaint, record every date from the first message. This page is not legal advice; for a disputed amount that matters to you, ask an advocate.
What the texts do not settle
The Act and Regulations read for this guide do not define "void" for online games, do not list the errors a licensee may correct after a prize is credited, and do not give a time limit within which the Authority must answer a player. Where a casino claims a power the texts do not state, the safe course is to ask for the approved clause and keep the reply. Gambling is addictive: if a dispute is affecting how you feel about play, see the responsible gambling page.
Questions and answers
Can a casino void my winnings because it says it made a mistake?
The Act and Regulations read for this guide contain no general power for a licensee to void a prize for its own error. A licensee must pay by the rules it published, and any reason it relies on has to appear in terms approved by the Authority. Ask which clause it relies on and put the question in writing.
Can the casino cancel winnings and keep my deposit as well?
Section 75 of the Act allows a licensee to deal with money standing to a player's account only to debit a wager, to remit funds at the player's request or to pay bank charges on deposits and withdrawals. Keeping a deposit does not fall within those three purposes.
Is a casino allowed to cancel winnings if I was self-excluded?
Yes. Regulation 74(1) requires a licensee to deny access to a self-excluded person, refund deposits made in violation within seven days and cancel winnings obtained in contravention of the exclusion. Regulation 74(2) adds that stakes are refunded and winnings are forfeited to the Authority.
Who decides whether I cheated?
Winning from gambling by unlawful means is an offence under section 110 of the Act, and a licensee must report fraud and malpractice to the Authority within twenty-four hours (r.91(2)). The Act and Regulations do not make the operator the judge of that question, so an allegation of cheating is a matter for the Authority and the courts.
How long do I have to challenge a cancellation?
Section 80 of the Act allows a party to an online gambling dispute to appeal to the Tribunal within fourteen days from the date of the dispute. The Act does not say whether that period pauses during a complaint, so note the date the cancellation was communicated.
What if the casino is not on the GRA list?
The duties in this guide bind licensees. If the company holds no Kenyan licence there is no licensee for the Authority to direct under section 37, and the texts read for this guide give no route to recover a balance from it.
